Protective Orders

If you are the victim of violence you may petition the First District Court for a protective order.

 

The purpose for a protective order is

  • Stop the Violence.
  • Prohibit Communication.
  • Order the Perpetrator to stay away from residence or anywhere frequented by victim.
  • No Weapons in the possession of the Perpetrator.
  • To gain possession of automobile and personal effects.
  • Temporary custody of children.
  • Other relief necessary for safety

 

Once the Ex-Parte (temporary) Protective Order is granted, it is served immediately. A court date is set for a Protective Order hearing. Violation of a Protective Order is a Class A Misdemeanor, and any subsequent violations may be enhanced to felonies.

 

Law Enforcement takes an aggressive role when dealing with Protective Order complaints.
